Insurance -- arbitration of amount of fire loss -- appointment of umpire. 1. A provision in a standard form fire insurance policy authorized by 1 Mason Minn. St. 1927, § 3512, that in case of partial loss due to fire where the parties do not agree as to extent of loss, that either party may demand an appraisal, each party to name an appraiser within 15 days after statement of loss has been rendered, and that the appraisers so selected shall name an umpire, provided that if after five days the two appraisers so appointed cannot agree on such an umpire the presiding judge of the district court of the county wherein the loss occurred may upon written application and notice appoint the umpire, requires the appraisers to name the umpire within five days and authorizes the judge of the district court to make the appointment if the appraisers cannot do so within the time stated, regardless of whether the inability is due to failure to agree after attempting to do so to failure to attempt to agree at all.
