Appellant Claude Daniel Nichols was convicted by a jury of the offense of driving while intoxicated. See TEX. REV. CIV. STAT. ANN. art. 6701--1 (Vernon Supp. 1994). The jury assessed punishment at two years in jail probated for two years and a fine of $2,000. On appeal Nichols raises three points of error contending: (1) the evidence is insufficient to support the conviction; and (2)-(3) the trial judge erred in admitting into evidence testimony resulting from an unlawful search and seizure under the Texas Constitution and laws and the Fourth and Fourteenth Amendments of the United States Constitution.
